
The Policies and Procedure Committee are working to revamp Protocols of Practice for Collaborative Divorce Texas members. The Protocols are designed to provide guidance and assistance to professionals using the collaborative process by utilizing a uniform approach to attain the best outcome for their clients. The protocols are to be used as a guideline, by professionals who are trained in the collaborative process. The protocols address the fundamentals of the process, the need to preserve its integrity, drafting considerations, the relationships between the attorney, the client, professionals, and other lawyers, and options if the process is not successful.
The protocols are designed to deal with issues commonly encountered in the collaborative process as well as descriptions of standard collaborative practices while ensuring that the opportunity and incentive for innovation is preserved. The Policies and Procedures committee will draw on carefully developed principles that have stood the test of time and represent the accumulated wisdom of practice, wisdom, and experiences of collaborative professionals. It is the committee’s hope that collaborative professionals embrace the protocols as the norm for use in the collaborative process in resolving disputes.
